Electronic Filing for Appeals

Effective October 1, 2014, providers requesting a hearing with an Administrative Law Judge (ALJ) must submit their request electronically to the Departmental Appeals Board (DAB) using the E-File at https://dab.efile.hhs.gov

Petitioners must register to be able to use the electronic filing system. Registration instructions are attached to the Letter. All documents must be submitted in Portable Document Format (“pdf.”).

Written requests for hearings will not be accepted unless the petitioner has no internet or computer access. Those petitioners can call the Civil Remedies Division to explain why they can’t file electronically. A request for a waiver can also be submitted with a written request. Confirmation of a waiver from e-filing will be received in writing. Sample language that can be used in the Appeal Rights notice detailing petitioners’ options for filing a hearing request is also attached to the Letter.
